These Terms & Conditions (“Terms”) apply when you browse or use this website and when you purchase products or services from Taonga By Mike (“we”, “us”, “our”). By using the site or placing an order, you agree to these Terms.
1) About us
- Business name: Taonga By Mike
- Website: taongabymike.co.nz
- Contact email: [admin@taongabymike.co.nz]
- Location: [Waihi, New Zealand]
2) Products and authenticity
We sell New Zealand pounamu and related items. Photos and descriptions are provided as accurately as possible, but pounamu is a natural stone and each piece will have unique colour, pattern, and inclusions.
Measurements and weights are approximate unless stated otherwise.
3) Orders and payment
- Prices are shown in NZD unless stated otherwise.
- Orders are accepted once payment is confirmed and you receive an order confirmation.
- Payment is processed through our e-commerce/payment providers (e.g., Ecwid, Stripe, PayPal). We do not store full card details on our servers.
- We may cancel or refuse an order where there is a genuine error (e.g., pricing/stock mistakes) or suspected fraud. If so, any payment received will be refunded.
4) Custom pieces and commissions
If you order a custom carved piece or commission work:
- Timeframes are estimates and can vary depending on design, stone, workload, and finishing.
- Custom/commission orders may require a deposit (e.g., [50%]) before work begins.
- Once carving has started, deposits are generally non-refundable unless we agree otherwise.
- Because custom pieces are made-to-order, returns may not be accepted for “change of mind” (see Returns below), except where required by NZ consumer law.
5) Shipping and delivery
- Shipping costs and estimated delivery times are shown at checkout or agreed in writing.
- We pack items carefully. Risk of loss or damage in transit passes as required by NZ consumer law.
- If an item arrives damaged, contact us within [48 hours] with photos of the packaging and item.
- International customers may need to pay customs duties/taxes; these are the buyer’s responsibility.
6) Returns, refunds, and exchanges
Under the Consumer Guarantees Act 1993 (CGA) and the Fair Trading Act 1986 (FTA), you have rights for products that are faulty, not as described, or not fit for purpose.
Change of mind:
- For standard (non-custom) items, we may accept change-of-mind returns within [7/14] days of delivery if the item is unused and returned in original condition.
- Return shipping for change-of-mind returns is the buyer’s cost unless we agree otherwise.
- Custom/commission items are generally not eligible for change-of-mind returns.
Faulty or incorrect items:
- If the item is faulty or significantly not as described, you may be entitled to a repair, replacement, or refund as required by NZ law.
- Contact us with your order number and photos. We’ll work with you to resolve it quickly.
7) Care and wearing jewellery
Pounamu is strong but can still chip or crack if dropped or hit. Normal wear and tear, accidental damage, and damage caused by misuse are not considered faults.
8) Website use and acceptable behaviour
- You agree not to misuse the site, attempt unauthorised access, introduce malware, or interfere with site operation.
- If we provide a forum/comments/testimonials, you must not post unlawful, abusive, defamatory, hateful, or harmful content.
- We may remove content or suspend accounts at our discretion to keep the community safe and respectful.
9) User content (testimonials, photos, forum posts)
If you submit content to us (e.g., a testimonial, review, photo, or forum post), you confirm you have the right to share it. Unless you ask us not to, you grant us a non-exclusive right to display that content on our website and marketing channels for the purpose of promoting our work.
If you want content removed, contact us and we will consider your request.
10) Intellectual property
All website content, photos, logos, and designs are owned by us or licensed to us. You may not copy, reproduce, or use our content for commercial purposes without written permission.
11) Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss. Nothing in these Terms limits any rights you have under NZ consumer law that cannot be excluded.
12) Privacy
We handle personal information in line with our Privacy Policy.
13) Changes to these Terms
We may update these Terms from time to time. The latest version will always be published on this page with a new “Last updated” date.
14) Governing law
These Terms are governed by the laws of New Zealand. Any disputes will be handled in New Zealand courts where appropriate.
